A spokesperson for the Judicial Conduct Investigations Office said:

The Lord Chief Justice, with the Lord Chancellor’s agreement, has issued Deputy District Judge (DDJ) Adam Tear with formal advice for misconduct. Judges are required to be courteous, tolerant and respect the dignity of all.

The JCIO received two complaints about DDJ Tear’s conduct during separate hearings.

Following an investigation carried out under the Judicial Conduct (Judicial and other office-holders) Rules 2014, a nominated judge found that DDJ Tear had acted in a rude and aggressive manner during both hearings.

Having considered the mitigation offered by DDJ Tear, the Lord Chief Justice and Lord Chancellor agreed with the nominated judge that DDJ Tear’s actions amounted to judicial misconduct and that the appropriate disciplinary sanction is formal advice.

Sanctions for misconduct by judicial office-holders are set out in the Constitutional Reform Act 2005. They are, in order of severity: formal advice, formal warning, reprimand and removal from office.
