A spokesperson for the Judicial Conduct Investigations Office said:
Mr Justice Keehan, on behalf of the Lord Chief Justice and with the Lord Chancellor’s agreement, has issued Mr Ken Stammers JP with formal advice for misconduct.
Two fellow magistrates sitting on a trial with Mr Stammers saw him using his phone during a trial, which is contrary to guidance given to magistrates. This resulted in the presiding justice having to admonish him in open court.
Following a judicial disciplinary investigation, a conduct panel of the London Conduct Advisory Committee found that Mr Stammers had used his phone during the trial. While there was no evidence that it had affected his attentiveness, the panel found that Mr Stammers’ actions lacked circumspection and had the potential to damage the reputation of the magistracy. Mr Justice Keehan and the Lord Chancellor agreed.

Sanctions for misconduct by judicial office-holders are set out in the Constitutional Reform Act 2005. They are, in order of severity: formal advice, formal warning, reprimand and removal from office.
